The Losing Status of China Cultural Relics
  
  The fate of the Chinese cultural relics had been changed completely from being rubbing, since the Peop-les¡¯ Republic of China was established Oct. 1, 1949. Since then, based on the new China national govern-ment management, not only the status of the cultural relics stolen and delivered out of China since Opium War, but also the government issued a set of laws or regulation to preserve the cultural relics and hist-
orical site and set up the mechanism of preservation the cultural relics. Historically, it was the first time for China to manage the cultural rel-ics. But unfortunately, the losing of the cultural relics does not stop, but a more concealed methodsmuggle. From the beginning of the new PRC to the Great Proletarian Culture Revolution£¬a many of the cultural relics had been destroyed severely because of the special era, but the cultural relics is rare been smuggled. After reforming, with the opening of the national gate and frequently communicating worldwide, the stealing and smuggling the cultural relics had been recovered. Since the 1980s¡¯, the degree had been great and it seemed that it is very difficult to control.

  The first shock wave of the stealing and smuggling the cultural relics is to resurrect the tumulus. Up to now so is the first source of smuggli-ng the cultural relics. In the 1980s, there is a saying which is popular in some province such as Henan, Shanxi, Shanxi, Gansu and the like that
¡°If you want to be rich, Resurrect the tumulus, you can be an person with tenthousand RMB.¡± At that ti-me, the activities of the resurrecting tumulus were very popular and without any control. Thousands of t-umulus are stolen. The goods in the tumulus were lost. In some places, grave pf martyr and new grave can-not escape this great calamity. Even though the ashes was throughout in the field. And the criminal meth-od is trend to collective, specialization and modernization, some of them contacted with the black hand. Some has organized the processing of the stealing, delivery and sales. This kind of group composed of se-veral persons, tens of persons¡­. In the processing of the criminal, they used the modern transferring a-nd communicating method, such as trunk, interphone and so on, and gun, detonator and knife, even though flight with the police dept. Some place became the main area to collect and deliver the cultural relics and caused several routs of smuggling. Recently, only in Xi¡¯an, the policeman arrested over 100 persons who smuggled the cultural relics to Japan, Hongkong, Macao, and got thousands of smuggling routs.

  The second shock wave is to steal museum. Up to now it is the second source to smuggle the cultural re-lics. There are so many valuable relics in museum, so it is easier to become the goal of the criminals.

  According the Statistic report, during 1984 to 1986, the policemen captured 55,000 cultural relics, am-ong 8,500 cultural relics are stored in national museum.

  Since in 1990s¡¯, the national cultural relics bureau checked the museum¡¯s stolen status as follows:

  In 1990, 48 cases of museum stolen in China with losing 635 cultural relics.
  In 1991£¬39 cases with losing hundreds of cultural relics.
  In 1992£¬38 cases with 432 stolen, among them119 are rare cultural relics.
  In 1993£¬38 cases with 295 stolen, among them, 28 are rare ones.
  In 1994£¬30 cases with 241 stolen, among them, 63 are rare ones.
  In 1995£¬23 cases with 231 stolen, among them, 62 are rare ones.
  In 1996£¬10 cases with 48 stolen, among them, 21 are rare ones. There were 18 cases that the historical culture area had been stolen, among them there are 17 cases in tem-ples or towers with 108 cultural relics stolen.
  In 1997£¬86 cases with 814 stolen, among them, 68 cases are related to
the statue by caved stone. There are hundreds of statues by caved stone were stolen.
  In 1998£¬51 cases with 233 stolen. Among them 38 cases related to the statues by caved stone and templ-es with 110 cultural relics stolen, 13 cases related to the museum with 123 stolen.

  Based on the Stat report, the museum is the main place which the criminal loves. And the situation is very serious. The number of the cultural relics stolen was horrendous.

  The third source of the cultural relics smuggling is resurrecting the fossil of oldenbiology. In recen-tly years, there is the trend to smuggle the valuable fossil of oldenbiology. During these two years, Gu-angdong Customs intercepts and captures several cases of smuggling the fossil of the biology which is fo-rbidden to export by the China government.
  According to the Stat from the Customs, during 1991 to 1996, the custo-ms intercepts and captures about 46000 the smuggled cultural relics; in 1997 more than 600 cases of smuggling with 11200 cultural relics, in the first half of 1998 12 cases of smuggling the with 370 cultural relics. M-eantime, there are some news said, that the light by bronze made in Han dynasty was resurrected in Sanxia, which was auctioned at USD250 in New York. Nobody can calculate how many and how the cultural relics had been smuggled.

  Cultural relics smuggling is the activity which disobeys the internati-
onal rule and is accused by the world. Cultural relics smuggling and related resurrecting and stealing n-ot only destroy the cultural relic, but also make the unrepairable losing of the human being¡¯s culture.
